A Will is a legal document that indicates how you would like your estate to be distributed after your death. Failure to make a Will can have serious financial consequences for your family.
Making a will not only keeps your affairs neat and tidy but it also allows you to leave your property to anyone you choose including perhaps that small bequest to a friend or passing on some personal piece of jewellery to a favourite niece. Where you have children it is particularly important to make a Will. If anything should happen to you who would look after the children? Where would they live? Would your money be properly invested for them? Or could it be claimed by someone else?
If you do not make a Will you die intestate, and the law then dictates where your money will go. Your family could therefore be caused unnecessary heartache and have financial problems that you never intend. Remember if you own a house, car, life assurance, bank or building society investments or saving certificates they all need to distributed after your death. A Will is generally straight forward and the fee for making a Will is not expensive. We can tell you how much it will cost when we take your instructions. We can also tell you more about your Executors, the people who have to carry out the terms of your Will, and any tax or duty payable because of your death.
There are two occasions when making a Power of Attorney is vital:-
You may already be looking after someone else's affairs particularly if they are infirm or elderly and worried that you do not have the proper authority. Perhaps you are wondering whether you will be asked in the future to account for your actions?
A Lasting Power of Attorney (introduced to replace Enduring Powers of Attorney) gives protection not only to the individual who appoints you Attorney- they will know that the right person is dealing with their affairs - but also to you as the Attorney. Remember if you have an Enduring Power, then you are under a duty to register with the OPG if the Donor is becoming unable to manage their own affairs. Let us help.
